Greetings,
The Covenants, Conditions and Restrictions (CC&R or Covenants) were recorded on all the platted lots in Blocks 1 through 29 by the original developers between 1970 & 1973. The CC&Rs require that there be a nonprofit corporation formed known as the Devils Nest Association (not to be confused with the existing Devils Nest Owners Association) with each lot owner being entitled to be a member with one vote per lot owned for directors to manage the Devils Nest Association. The covenants also require that an Architectural Committee, created by the Association, approve building plans prior to the plans being submitted to the Knox County Zoning Administration for a building permit.
Since previously there has been no actual entity in Nebraska named Devils Nest Association with an Architectural Review Committee, consider this official notice that Devils Nest Association (the Association) has now been formed as a not-for-profit corporation in the State of Nebraska. The initial Directors of the Association are: Rod Tompkins, Jill Brodersen, Monda Kohles, Denny Tilton, Lou Wiltse, Jim Coburn, and Jim Pelster. The initial members of the Architectural Committee of the Association are Jill Brodersen, Monda Kohles, and Lou Wiltse.
It is anticipated that the Owner’s Association will assess dues of one dollar per vacant lot, $10 for each lot owner with a part time residence, and $20 for each full-time residence homeowner to cover the legal fees and mailing costs. Last month, Devils Nest Development, LLC purchased the last unsold 962 lots and 120 acres of unplatted land from Devils Nest II, LLC with plans to combine several lots into larger half acre to five acre building sites. Jill Brodersen is the majority owner and managing partner of Devils Nest Development, LLC with other owners Rod Tompkins, her father of Wayne, NE and Monda Kohles of Devils Nest, Crofton, NE.
